Locket Junkie Consultant Terms & Conditions

You agree that you are 18 years or older, reside in the United States, and are legally eligible to work in the United States. You also agree to the following and understand that the below terms and conditions may be altered at any time, but that you will be notified of any changes:

 Branding

Tables displayed at craft shows or other vendor events must be covered with a floor length teal, black, gray, or official Locket Junkie branded tablecloth.

  • Any photos used in displays or social media must be official Locket Junkie images found on the Locket Junkie Facebook Page, Consultant Group, or Instagram (@LocketJunkie) profile. Producing your own images to share is allowed, please note that any personally photographed images must not contain any jewelry not issued by Locket Junkie.
  • You may not create a new logo, website, company name, or any other type of branding that may lead a customer to believe that the product you represent is something other than Locket Junkie.
  • You may create a “routing” website to lead your customers back to your personal shopping link for marketing, sales or shopping purposes.
  • You may create links within other websites, clearly labeling it as a link to Locket Junkie, and directing it directly to your personal shopping link.

Social Media

  • It is encouraged to use social media to promote your sales of Locket Junkie.
  • You agree to not recruit customers off the Company’s official social media pages and understand that this type of solicitation can make for an awkward situation for the customer, but also may directly interfere with another consultant’s business.

Customer Service and Representing Locket Junkie

  • You understand that collecting orders by paper and placing orders online later may result in an item being sold or out of stock before you are able to purchase it. In this situation, you agree to work with your customer to determine if he or she wants to wait for the product to come back (with the exception of Clearance items), or if they would like to replace the product with another Locket Junkie product.
  • You agree to promptly reply to your customer’s questions, and always act with professionalism, kindness, and never engage in negative comments or conversations about Locket Junkie, or other direct sales companies.
  • You agree to take a genuine interest in your customer’s story, and ask questions about what is important to him or her.
  • You agree to be a positive energy and presence when displaying and selling Locket Junkie jewelry, even with neighboring direct sales representatives at events.
  • You agree to always represent Locket Junkie and its products in an enthusiastic and positive

 About the Sale

  • You agree to share a personal shopping link to route your customers back to locketjunkie.com, and that only when this link is used, you will receive commission for your sale.
  • You agree to receive email notifications alerting you to sales when they are made.
  • You agree that order summaries containing specific customer and product information may be delayed after launching our new consultant shopping link and dashboard.
  • You agree to monitor your consultant dashboard for transactions and paid status.
  • You agree to be paid once weekly, usually by Friday of each week, sometimes sooner depending on holidays or unforeseen events.

 Commission Rate and Payment Rules

STAY THE SAME: GRANDFATHERED CONSULTANTS ONLY:

Should you choose to “Stay the Same”, the following is a description of the program you agree to.

  • You agree to an entry level commission rate of 40% on your own personal sales only.
  • You acknowledge that as of 06/26/2017 there is now a structure for team building but you decline this offer.
  • You acknowledge that payments will be made via Dwolla (dwolla.com) and all individual tax information will be handled through Dwolla and its guidelines/requirements, located here.
  • You agree that your 40% commission rate will be calculated based on Retail Sales total, which is the order total less applicable taxes, shipping, and Kudos or Promotional discounts, and excludes consultant specific products like brochures, more trays, and other business tools.
  • You agree that all sales will be made through your own personal shopping link and your applicable commissions will be paid weekly. (There is no longer a discount code to shop.)
  • You agree that sales will be monitored for fraud and that fraudulent sales may not be paid in full and may warrant your termination as a Locket Junkie consultant.
  • You agree that as of 06/26/2017 there are no minimum sales requirements to stay active with Locket Junkie while in the “Stay the Same” program, and that you may take a leave of absence from sales and return at any time to continue where you left off. You agree that a minimum sales requirement may be instated in the future but that you will be adequately notified of such a change.
  • This program no longer includes a $50 bonus when a consultant signs up “below” you and reaches a sales goal of $500 Retail Sales. This program will no longer have a way to indicate if a consultant is signing up “below” you.
  • You can choose the “Stay the Same” program and later “Opt In” when it better suits you.

OPT IN: GRANDFATHERED CONSULTANTS AND ANY NEW CONSULTANTS ON OR AFTER 06/26/2017.

Should you choose to “Opt In”, the following is a description of the program you agree to.

  • You agree to an entry level commission rate of 30% on your own personal sales.
  • You agree to receive a 5% commission on any team members’ sales who are recruited directly below you (referred directly by you).
  • You acknowledge that as of 06/26/2017 there is now a structure for team building and you have officially accepted this offer, and that once accepted, there is no way to revert back to our old program.
  • You acknowledge that payments will be made via Dwolla (dwolla.com) and all individual tax information will be handled through Dwolla and its guidelines/requirements, located here.
  • You agree that your above commission rates will be calculated based on Retail Sales total, which is the order total less applicable taxes, shipping, and Kudos or Promotional discounts, and excludes consultant specific products like brochures, more trays, and other business tools.
  • You agree that all sales will be made through your own personal shopping link and your applicable commissions will be paid weekly. (There is no longer a discount code to shop.)
  • You agree that sales will be monitored for fraud and that fraudulent sales may not be paid in full and may warrant your termination as a Locket Junkie consultant.
  • You agree that as of 06/26/2017, there is a minimum sales requirement of $150 each rolling 90-day period to stay active with Locket Junkie. Failing to meet this minimum sales requirement will terminate your status as a consultant with Locket Junkie and will lose any rights to team members you have built up until the point of termination.

 Team Building

For “Opt In” consultants, or consultants joined on or after 06/26/2017. (As long as you are in the “Stay the Same” program you have officially declined to build a team.)

  • In order to add a new team member, you must share your recruitment link and the new team member must join by following that link. Your new team member will automatically be assigned to your team at the time of approval, and you will be able to view any sales she makes with information including order total and commission rate.
  • Team members that joined “under” you while in the “Old/Stay The Same” consultant structure will automatically be assigned to your team should they also choose to opt in.
  • New team members will be manually approved into the program, as Home Office will need to verify they have purchased a Starter Kit or the Start Online option.
  • Your team members will also be held to a minimum sales requirement of $150 each rolling 90-day period to stay active with Locket Junkie. Failing to meet this minimum sales requirement will terminate his or her status as a consultant with Locket Junkie. You are encouraged to help coach your team member to be able to remain active as a consultant or risk losing her sales as additional income to your weekly commissions.
  • At this time, you are only able to build a one-level team. As illustrated in the chart below, you would only earn a commission off the team members marked with an asterisks (*).

 Other Direct Sales Companies

  • You agree to not sign up with or cross promote, and that you are not already signed up with, any other direct sales company that sells jewelry as its primary product. Example: Paparazzi, Stella & Dot.
  • You understand that you can sign up for other direct sales companies if they do not sell jewelry as their primary product. Example: Scentsy, Advocare, Thirty-One Handbags.
  • You may not sell another company’s lockets, charms or accessories (example: Origami Owl, KEEP Collective.), for any reason, and that doing so may deem your sales unpayable and may be considered a violation of the Non-Compete section of these Terms & Conditions.

Non-Compete

  • You agree that even after terminating a relationship with, or being terminated by, Locket Junkie you will not be allowed to sell lockets through another company, or establish your own company to sell items easily comparable to Locket Junkie products without being subject to a charge of 100% of sales for the first two years of business.
  • You agree that you will be responsible for any, and all, legal fees billed to Locket Junkie, its executives, employees, owners, founders, board or Joslyn (Josi) Biddle during an investigation of possible competition.
  • You agree that all trials, court dates, and in person appearances will occur in Iowa, United States.

 Warranty, Exchange Items, Lost/Stolen/Damaged Items by Mail

  • Items that have been lost, stolen or damaged in mail will be replaced in full. To submit an Order Replacement, please go to locketjunkie.com, click Help, then Lost or Damaged Mail.
  • Locket Junkie products hold a 30-Day Warranty and issues such as, but not limited to, glass coming loose and falling out as a whole piece, and magnets lifting, will be covered. Any sign of damage will void the warranty, including shattered glass, excessive roughness, or long-term wear. To have a product replaced by warranty please email info@locketjunkie.com with photo evidence of the defected product and order number from which the product was obtained.
  • Items purchased from Locket Junkie may not be returned for refund, but can be exchanged for other Locket Junkie product, or for in-store credit. Any product with signs of wear or damage will not be exchanged and no in-store credit will be issued. Exchanges and in store credit issues are left to the discretion of Locket Junkie Home Office. To exchange a product please return the package to Locket Junkie3104 SE 20th StreetAnkeny, IA 50021.

 Trade and Company Secrets

  • You agree that any information regarding the inside business structure of Locket Junkie, its partners, manufacturers, affiliates, or any other non-public information that aid in the success of Locket Junkie as a growing company, will remain confidential.
  • You understand that releasing confidential company information may warrant your termination from the Locket Junkie consultant structure and you may be held legally and financially liable for any foreseeable company losses as a result of your indiscretions.

Liability Waiver

  • You agree that Locket Junkie, its executives, employees, owners, founders, board, or Joslyn (Josi) Biddle, will not be held liable for any damages/issues that you may perceive including but not limited to:
    • Allergic reactions to metals
    • Loss or theft of product
    • Allegations of perceived damages/issues perceived by customers or consultants
    • Travel safety including physical bodies or vehicular

 Personal Information and Data

  • You agree to safeguard any customer information and data by keeping it in a secure location, or if online, by only using trusted and reputable data housing for storing personal information.
  • You agree to keep your personal information updated with Locket Junkie for everyday use. Examples: Name changes, change of address, phone number or email.
  • You agree that your personal shopping link will default to locketjunkie.com/_______, as you indicated within the registration form. To edit this link, you must send a request to info@locketjunkie.com, and should the link not already be in use, your link will be complimentarily updated.

You agree that any questions or concerns will be brought to the immediate attention of a Locket Junkie Home Office employee at info@locketjunkie.com. Topics, questions and concerns not addressed in this document can and will be resolved by Locket Junkie at a later date.
